Mental Capacity Assessments
We conduct detailed, legally sound assessments of a person’s ability to make decisions in line with the Mental Capacity Act (MCA) 2005. These reports are essential for:

What is a Mental Capacity Assessment?
The Mental Capacity Act 2005 outlines a two-stage test to determine whether someone has the ability to make a specific decision at a specific time.
Stage 1 – The Diagnostic Test:
Does the person have an impairment or disturbance in the functioning of the mind or brain (e.g., dementia, stroke, brain injury, learning disability)?
Stage 2 – The Functional Test:
Is the person unable to do one or more of the following:

Understand the relevant information?

Retain that information long enough to make the decision?

Use or weigh that information as part of the decision-making process?

Communicate their decision (by any means)?
If the answer is ‘yes’ to both stages, the person may lack capacity in relation to that specific decision.
What is a Lasting Power of Attorney (LPOA)?
A Lasting Power of Attorney is a legal document that allows someone (the ‘donor’) to appoint another person (‘attorney’) to make decisions on their behalf, should they lose mental capacity in the future.
There are two types of LPOA:

Health and Welfare LPOA – Covers medical treatment, care arrangements, and daily living decisions.

Property and Financial Affairs LPOA – Covers managing bank accounts, paying bills, and handling property matters.
A Mental Capacity Assessment may be needed if there are concerns about the donor’s ability to understand the implications of creating an LPOA.
